Toscana in Tour srl (the lessor) agrees to rent to the customer (the client) the vehicle indicated on the front of this rental agreement ( the vehicle) under the terms and conditions stated below:
Art. 1 – The minimum age to rent scooters or moped is 18 years. For drivers under 18, parental consent is required and will assume full responsibility.
Art. 2 - The rental begins on the date and time the Vehicle is delivered to the Client as indicated on the front of this rental agreement, and ends on the date and time is returned to Toscana in tour. The vehicle is delivered to the customer in perfect condition, except for any damages noted on the front of this agreement. The Client agrees to return the Vehicle in the same condition, except for normal wear from usage, on the date and time indicated. If the Client wishes to change the return terms (date, place, time), prior approval must be obtained from Toscana in tour at least 24 hours before the scheduled return.
Art. 3 - The vehicle may only be driven by the Client or a person indicatedat the time of the agreement, except as provided in Art. 1. At the time of signing, the Client must present a valid driver's license appropriate for the type of Vehicle. The Vehicle may not be transferred to others. The Client expressly agrees to be responsible for the actions or omissions of anyone driving the Vehicle, unless due to unlawful acts beyond the Client's control.
Art. 4 – The vehicle must not be driven by anyone under the influence of alcohol, drugs, or any altered state of consciousness, or any psychophysical condition in violation of traffic laws. It must not be used for illegal purposes, racing, passenger transport for hire and may not leave Italian territory unless previously authorized by Toscana in Tour.
Art. 5 – The Client and any authorized driver are covered by third.-party liability insurance (RCA) with a maximum limit of 6.000.000,00 euros, and a deductible of 250,00 euros payable by the Client.
Art. 6 – The Client is fully responsible for any damages caused by improper use of the Vehicle, including theft, loss of keys or use in violation of laws and regulations.
Insurance does not cover:
a) Damages to Toscana in Tour srl for immobilization of the Vehicle due to repairs required form Client's fault;
b) Towing costs unless covered by insurance and/or repair costs;
c) Damage to the driver, transported objects or luggage;
d) Any damages to the frame, wheels, paintwork, mirrors or top box;
Art. 7 - In case of an accident, the Client must inform Toscana in Tour srl by phone or in writing within 24 hours, fill out the accident report form (CID)) and ensure the incident is reported to the competent authorities.
Art. 8 – In the event of a breakdown or accident, it is strictly forbidden to have the Vehicle serviced or repaired by anyone not authorized by Toscana in tour srl.
Art. 9 – Rental payment must be made in advance. Credit cards are accepted. If the rental period is extended, the current rate for the additional time will apply.
Art. 10 – The vehicle is delivered with a full tank of fuel. If it is not returned full, the Client will be charged Euro 20.00 for the refueling service, plus the cost of the missing fuel.
Art. 11 – If the vehicle is returned outside of office hours (PISA 10:00-13:30 15:30-19:00; FLORENCE 9:30-13:00 15:00-18:00) or to a location other than the official Toscana in Tour office, an additional charge of euros 25,00 will aplly for each hour late and each kilometer of distance.
Art. 12 – All Vehicles must be returned on the agreed date and time iindicated on the front of this rental agreement. Failure to do so will result in a charge equal to one extra rental day.
Art. 13 – In case of lost keys, the Client must reimburse an amount of Euro150.00, plus any recovery costs. If the documents or license plate are lost, the reimbursement amount is Euro 200.00.
Art. 14 – A security deposit of 400€ is mandatory. If damages are found uponn return of the Vehicle, the deposit will be retained as partial compensation, without prejudice to any further claim for damages. The Client is fully liable for daamges unless KASKO INSURANCE is purchased, which limits liability to 400 euro.
Art. 15 – The deposit must be guaranteed bycredit card.
Art. 16 – Any dispute arising from or related to the Vehicle rental shall fall under the exclusive jurisdiction of the Court of Pisa. All obligations and performances required from the Client under this contract, including compensation for non-performance or improper performance, must be fulfilled at the Lessor's registered office.
Art. 17 – In the event of discrepancies between different language versions of this rental agreement, the Italian version shall prevail.
Art. 18 – Personal data will be used solely for purposes related to this contract and may be shared with third parties only for such purposes, in accordance with Italian Law 196/2003.
Art. 19 – The Client agrees to inform Toscana in Tour if, during the rental period, any fines are issued to the Vehicle, even if the Client has already paid them, by providing proof of payment. In the event of a fine, a €20 + VAT administrative fee will be charged, in addition to the full amount of the fine, which remains the sole responsibility of the Client.
Art. 20 – (Delayed charge/Addendum) - The Client hereby authorizes Toscana in Tour to charge their credit card for any amount due directly or indirectly in connection with the rental, even after the rental period has ended. This includes vehicle damage, unpaid fines, tolls, and parking fees incurred during the rental. The Client also consents to receiving all related communications, including post-rental notices, by email at the address provided to the Lessor, thereby waiving postal notification.Toscana in Tour sas ( proprietor ) agrees to rent to the customer (customer) the vehicle indicated on the front of this letter (vehicle) of rental as per the terms and conditions set out below:
